Creative Project Submission; Independent Development; No-Conflict / No-Liability

 

By submitting, presenting, sharing, or otherwise providing any script, screenplay, treatment, pitch, concept, idea, deck, short film, feature film, television project, or other creative materials (collectively, the “Submitted Materials”) to Create The Writers Room (“CTWR”) in connection with the Master Class, the submitter (“Participant”) acknowledges and agrees to the following:

1. No Obligation to Use or Consider.
Submission of any Submitted Materials does not create any obligation on the part of CTWR or any of its parents, subsidiaries, affiliates, partners, sponsors, instructors, mentors, employees, officers, directors, agents, representatives, or related entities (collectively, the “CTWR Parties”) to use, develop, produce, purchase, option, finance, distribute, represent, or otherwise exploit the Submitted Materials.

2. Independent Development and Existing Projects.
Participant acknowledges that the CTWR Parties, and/or individuals or entities affiliated with or associated with the CTWR Parties, may independently develop, acquire, commission, produce, finance, distribute, or otherwise work on projects, programs, scripts, concepts, characters, themes, stories, formats, or other creative materials that may be similar or substantially similar to the Submitted Materials, whether such development occurs before or after Participant’s submission.

Participant further acknowledges that the CTWR Parties may have previously received, reviewed, or independently developed materials containing ideas, concepts, themes, characters, storylines, formats, premises, or other elements that are similar to or identical with elements contained in the Submitted Materials.

 

3. No Claim Based on Similarity.
Participant agrees that the existence, development, production, distribution, or exploitation by any CTWR Party of any project or material that is similar or substantially similar to the Submitted Materials shall not, by itself, constitute infringement, misappropriation, breach of contract, breach of confidence, unfair competition, or any other violation of Participant’s rights, nor shall such similarity give rise to any claim for compensation, credit, ownership, accounting, injunctive relief, or other remedy, to the fullest extent permitted by applicable law.

 

4. No Confidentiality Obligation.
Unless CTWR expressly agrees otherwise in a separate written agreement signed by an authorized representative of CTWR, Participant understands and agrees that the CTWR Parties are not accepting the Submitted Materials on a confidential basis and have no obligation to maintain the confidentiality of the Submitted Materials.

 

5. No Representation of Originality by CTWR.
Participant understands that CTWR does not represent or warrant that any ideas, concepts, materials, projects, or creative elements discussed during the Master Class are unique or original to Participant. The Master Class is intended to provide education, feedback, mentorship, and professional development and is not a submission, acquisition, option, shopping, representation, or production agreement.

 

6. Release of Claims.
To the fullest extent permitted by applicable law, Participant releases and agrees not to hold liable CTWR or any of the CTWR Parties for any claim arising from or relating to the review, discussion, development, production, distribution, or exploitation of materials that are similar to or contain elements similar to the Submitted Materials, except to the extent arising from conduct that cannot lawfully be waived or released.

 

7. Participant’s Representations.
Participant represents that they have the legal right to submit the Submitted Materials and that doing so does not knowingly violate any agreement, obligation, or third-party rights. Participant further agrees not to submit materials that they are legally prohibited from sharing.

 

8. Continuing Effect.
This provision shall survive Participant’s completion or withdrawal from the Master Class and shall remain effective with respect to the Submitted Materials and any claims arising from their submission.

By submitting or presenting materials through the CTWR Master Class, Participant acknowledges that they have read, understood, and voluntarily agreed to these terms.
